Ahmedabad: The Gujarat High Court on Friday extended the temporary bail of Swayambhu saint Asaram, who was serving life imprisonment in the 2013 rape case citing medical reasons, for three months. On January 7, the High Court gave Asaram an interim bail in the rape case registered by the Gujarat Police till 31 March. He is currently undergoing Ayurvedic treatment in Jodhpur, Rajasthan. The three -month period was scheduled to end on Monday, so his lawyers requested the Gujarat High Court to provide additional bail for three months.
Relief for treatment
86 -year -old Asaram, who is serving a life sentence, has been given relief to treat his heart disease and other health problems. According to the information, Asaram had demanded six months of interim bail from the High Court. The matter went to the larger bench due to the separate opinion of the two-judge bench. The bench sanctioned three months interim bail during the hearing.
The court said this
Justice AS Supehia said in his order, (Partition), in the light of the overall appreciation of the orders passed by the bench and the order of the Supreme Court, I think that the applicant deserves interim bail. It cannot be said that an 86 -year -old sick person can be limited to a particular medical or system of drugs.
Two judges had different opinions
Earlier in the day, a bench of Justice Ilesh J Vora and Justice Sandeep N. Bhatt gave different decisions. Justice Vora granted Asaram temporary bail for three months, while Justice Bhatt dismissed the petition. Justice Bhatt said in his disagreement that Asaram had met several allopathic and Ayurvedic doctors from 28 January to 19 February. Justice Bhatt said that it is very surprising from the papers of the case presented by the applicant in the records that although it has been claimed that Ayurvedic treatment was going on, these papers show that Asaram turned to the concerned hospital for his illness only on March 1 despite being on interim bail since January 7.
